A Cumberland man who has been in jail for two months since he pleaded guilty to his fifth drunk driving offense was sentenced to 18 months in prison Friday, March 10, 2023, in Barron County Circuit Court.
Benjamin R. Berke, 41, also lost his driver’s license for life and was fined $600, court records said. His prison term will be followed by two years of extended supervision, during which he will be required to undergo all treatment and evaluations as recommended by his probation agent.
The prison sentence gives Berke credit for 61 days already served.
Court records said Berke had a blood alcohol level of .296, between three and four times the state’s legal limit of intoxication (.08) when he crashed his car on a roundabout in Turtle Lake in May 2021, then drove to a nearby hotel.
The arresting officer found a sport utility vehicle in the hotel parking lot with damage to the undercarriage. The airbags had deployed, and two tires had fallen off their rims.
A clerk at the hotel registration desk told the officer that Berke had just checked in, and pointed out his room.
